A story appearing in the February 3 online edition of the “Modesto (California) Bee” newspaper (http://www.modbee.com), reported that racer Nicky Moore, 18, was arrested February 2 by the Modesto Police Department “for investigation of assault with a deadly weapon. Investigators believe he stabbed the victim twice in the leg and beat him with a baseball bat…” The alleged incident occurred January 28.

The report went on to state that Moore was being held in the Stanislaus County Jail in lieu of $20,000.

“It’s complicated. It’s not true,” Moore told Roadracingworld.com in a telephone interview February 18. “I just talked to the cops about it.

“I was just in the wrong place at the wrong time. Me and my girlfriend were on our way home from the movies, and we saw some of our buddies getting into a big fight, like with bats and stuff. I never got out of my truck, but my truck is real noticeable. It’s lifted like seven inches and has flames through the windows.

“They (Modesto Police) had me go down there (to the station) to give a statement. I was never arrested, never charged.

“The guy who got beat up is almost dating my sister. They’re talking and stuff. He knows I didn’t do it.”

Moore said he was never contacted by the Modesto Bee.

Roadracingworld.com then called the Modesto Police Department to clear up the conflicting stories and reached officer Rick Applegate in the MPD’s Media Relations department.

“He (Moore) was booked. I have a booking register that shows he was booked into the jail for assault with a deadly weapon and he posted $20,000 bail,” said Applegate, who was listed as a source in the Modesto Bee article.

Further attempts to reach Moore were unsuccessful.
