MotoAmerica: Josh Herrin Penalized For Actions After His Crash In Race Two At WeatherTech Raceway Laguna Seca

According to the Judicial Procedures of the 2018 MotoAmerica Regulations and Procedures we confirm the sanction that has been imposed upon you.

Motive

Following your crash at T8A during Superbike Race 2, you acted in an irresponsible manner, causing danger to to other competitors and corner workers (extended yellow flag period in a high risk impact zone) Art 1.21.b. You were also observed making hostile behaviour towards the corner workers, refusing to obey their instructions, to withdraw to a safe position given the obvious damage to your motorcycle which rendered it clearly unable to rejoin the race. This is considered an act prejudicial to the interests of the sport. Art 3.3.1.2.

Hearing

You were required to attend a hearing with the Race Direction. You attended the hearing and acknowledged the facts presented to you.

Sanction

For the above reason, and accordance with the MotoAmerica 2018 Disciplinary and Arbitration code, the Race Direction has decided to penalise you with a drop of three grid positions for the FIRST race at Miller, and two penalty points on your competition licence.

Right of Appeal

According to 1.7 of the 2018 MotoAmerica Regulations and Procedures, you have the right to appeal against this decision, to the FIM North America Stewards, within 30 minutes from the date and time of receipt of this decision. The appeal must be lodged in writing stating the grounds for the appeal and accompanied by the appeal fee of $1,500.
