NOTIFICATION OF SANCTION
To: The Team of Pol ESPARGARO, Rider No. 44 of the MotoGP Class.
Dear Sir,
According to Article 1.21.20 of the FIM World Championship Grand Prix Regulations, we confirm our decision.
Motive
On 10 November 2017 at the conclusion of FP2 of the GRAN PREMIO MOTUL DE LA COMUNITAT VALENCIANA, technical control advised you were found to be using an engine outside the FIM MotoGP engine durability specifications.
This contravenes the Article 2.4.3.3.4 of the FIM World Championship Grand Prix Regulations “Should a competitor, for any reason (e.g. mechanical failure, crash damage, etc.) require the use of another engine above their allocation, the Technical Director must be informed before the new engine is used, and Race Direction will apply the appropriate penalty according to the Sporting Regulations (Art. 1.21.20).”
Convocation
You were summoned to attend a hearing with the FIM MotoGP Stewards Panel. You attended the hearing and acknowledged the facts presented.
Sanction
For the above reasons, according to Article 1.21.20, the FIM MotoGP Stewards Panel has imposed upon you a penalty requiring you to start the GRAN PREMIO MOTUL DE LA COMUNITAT VALENCIANA MotoGP Race from the pit lane 5 seconds after the green light is on at the pit lane exit.
Right of Appeal
According to Articles 3.4.2, 3.4.6, and 3.4.7 of the FIM World Championship Grand Prix Regulations, you have the right to appeal against this decision of the MotoGP Stewards Panel to the FIM Appeal Stewards. A statement of appeal must be made within 30 minutes from the date and time of this notification, and accompanied by a security deposit of €1320. The appeal can be lodged with IRTA who may also arrange for guarantee of the security deposit payment.
